These terms cover a DirecSites plan. They are written to be read, not to be survived. If a sentence here is unclear, email us and we will fix the sentence.
01Who you are dealing with
DirecSites is a division of Direcstaff LLC, 9550 South Eastern Avenue, Suite 253, Las Vegas, Nevada 89123. In these terms, we and us mean Direcstaff LLC trading as DirecSites, and you means the business on the plan.
02What the service is
A monthly plan that includes a website built and maintained by us, hosting for that site, and the add-on services listed on the pricing page. Add-ons can be switched on and off month by month.
03The preview
We often build a site before there is any agreement, and send it as a preview. A preview costs nothing, obliges you to nothing, and is not an offer you have to answer. We may take a preview down at any time, and we will take it down on request.
04What you pay
- The plan is $149 a month.
- Add-ons are charged at the prices on the pricing page.
- Whatever combination you pick, the monthly total stops at $349 a month. If your selections add up past that, you are billed $349 a month.
- There is no setup fee and no build fee.
- Prices are in US dollars and do not include any tax that may apply.
Billing runs monthly in advance, by card, through Stripe. The first month starts on the day the site goes live on your domain, and nothing is charged before that.
05Changing or cancelling
The plan is month to month. There is no contract to sign, no minimum term and no cancellation fee.
Switch an add-on off and it comes off the next invoice. Cancel the plan and the month you have paid for finishes out, after which billing stops. Cancellations go to [email protected].
06Who owns what
You own the site. The pages, the copy written for you and the image licences bought for your build are yours. The domain is registered in your name and transfers out whenever you ask.
You can ask for a full export at any time, for any reason, including while the plan is running. There is no fee for it.
What stays ours is the underlying tooling: the build system, our internal components and anything we use across every customer. Those are not part of the export, and nothing in the export depends on them.
Hosting ends when the plan ends, so the copy we host stops being served. The export and the domain are yours to put wherever you like.
07What you are responsible for
- That the information you give us is accurate, including licences, prices and service areas.
- That you have the right to use the logos, photographs and text you send us.
- Keeping your own access to the domain registrar and any accounts you connect.
- Reviewing anything the service drafts on your behalf before it goes out, where the service is set up to wait for your approval.
08How the services may be used
The receptionist answers calls that come in to your line. It is inbound only. It may not be used for outbound calling, cold calling or automated campaigns, and we will switch it off if it is.
The site and the services may not be used for anything unlawful, or for content that infringes somebody else's rights.
09Availability
We host the site on infrastructure that is monitored, and we fix what breaks. We do not offer an uptime guarantee and we do not publish a response time, so please do not read one into this page. When we are ready to commit to numbers, they will appear here in writing.
Parts of the service depend on other companies: the host, the payment processor, the phone platform and the search and review platforms. When one of those has an outage, that part of the service is out with it.
10Changing prices or these terms
If the price of your plan changes, you get notice by email before it takes effect, and you can cancel instead. Existing add-ons keep their price for the notice period. Changes to these terms are dated at the top of the page, and significant ones get an email.
11Liability
We are responsible for doing the work described here with reasonable care. We are not responsible for lost profits, lost business or indirect losses. Where we are liable, our liability is limited to the fees you paid us in the twelve months before the claim.
Nothing here limits anything that cannot be limited by law.
12Which law applies
These terms are governed by the laws of the State of Nevada, and any dispute belongs in the courts of Clark County, Nevada.
